Korte, kinatigan ang TVJ sa “Eat Bulaga” ownership

KINATIGAN ng Marikina City Regional Trial Court ang TV hosts na sina Tito Sotto, Vic
Sotto, at Joey De Leon o TVJ na siyang tunay na nagmamay-ari ng “Eat Bulaga” at “EB”
trademarks.


Naglabas ng desisyon ang korte ilang linggo matapos na magbigay nang katulad ng
desisyon ang Intellectual Property Office of the Philippines.


Sinabi nina TVJ, “In a Decision dated Dec. 22, 2023, received by TVJ’s lawyers from
DivinaLaw on Jan. 5, 2024, the Regional Trial Court (RTC) Branch 273 of Marikina City
granted TVJ’s Complaint against TAPE. As such, the court prohibited TAPE and GMA
from using the trademarks “EB” and “Eat Bulaga,” [incuding] the Eat Bulaga jingle,
from its shows.”


Dahil dito, pwede nang gamitin nina TVJ ang trademarks at jingle sa kanilang programa
sa TV-5.


Napatunayan ng korte na si Joey de Leon ang lumikha ng trademark “Eat Bulaga,” at
hindi ito napasinungalingan ng TAPE.


Sa ilalim ng “2020 Revised Rules of Procedure for Intellectual Property Rights” Cases,
anumang utos mula sa korte ay dapat kaagad na ipatupad, kahit na umapela pa ang
kabilang partido. Kaya walang dahilan ang TAPE o GMA na gamitin ang naturang
trademark kahit na umapela pa sila sa korte.


Wala pang opisyal na pahayag ang TAPE o GMA sa desisyon ng korte.
