Special election para sa nabakanteng pwesto ni Teves

SIMPLENG voice vote.
Ito lamang ang kailangang para opisyal na maideklarang bakante na ang pwesto ni Rep.
Arnulfo “Arnie” Teves, 3 rd District, Negros Oriental.


Ayon sa House Rules, ang voice vote o “viva voce” ang pinakamabilis na paraan para
malaman ang pagboto ng nakararami. Mas mabilis ito kaysa sa pagbilang ng mga
nakataas na kamay o idaan sa paggamit ng balota.


Pinagtibay ng House Resolution (HR) No. 1212 ng Kongreso na bakante na ang pwesto
ni Teves noong Martes, at inatasan ang Commission on Elections (Comelec) na
magsagawa ng special election para rito.


Ang resolusyon ay inihain nina Speaker Ferdinand Martin Romualdez, House Majority
Leader Manuel Jose “Mannix” Dalipe at Minority Leader Marcelino Libanan.


Nabakante ang pwesto ni Teves dahil sa “disorderly behavior and violation of Section
141 (a) and (b), Rule XX of the Code of Conduct of the House of Representatives, by the
requisite vote of two-thirds of all its members as provided for in the Constitution.”

Ayon sa Section 9, Article VI ng Konstitusyon, kapag nagkaroon ng bakanteng pwesto
sa House of Representatives, isang taon bago ang regular elections, magkakaroon ng
special election para malagyan ang nabakanteng pwesto nang naayon sa batas.


Ayon sa RA No. 7166, o ang synchronized elections law, ang special election ay hindi
dapat mas maaga sa siyam na araw o lalampas ng 90 araw mula sa pagkaka-deklara ng
vacancy.


Sinabi kamakailan ni Comelec Chair George Garcia na handa itong magsagawa ng
special election, gaya ng hiniling ng Kongreso.


Madidiskaril kaya ang special election sakaling maghain ang abogado ni Teves ng
temporary restraining order sa Korte Suprema, dahil hindi naman ito na-convict ng korte
sa kahit na anong kasong kriminal?
