SC sa Metro Manila LGUs: pag-isyu ng OVR, pangungumpiska ng driver’s license, itigil na

INUTUSAN ng Korte Suprema ang 17 local government unit ng Metro Manila na itigil na ang pag-isyu ng sariling ordinance violation receipts (OVR) gayundin nang pangungumpiska ng driver’s license.

Sa halip, ayon sa Kataas-taasang Hukuman, gamitin na lamang ang ipinatutupad na single ticketing system (STS) ng Metro Manila Development Authority (MMDA).

Sa 42-pahinang En Banc desisyon, pinawawalang-bisa nito ang lahat ng ipinatutupad na ordinansa ng 16 na lungsod at isang munisipyo sa National Capital Region (NCR) may kinalaman sa batas trapiko.

“All told, the Court thus declares as invalid the common provision in the said traffic codes or ordinances of the LGUs in Metro Manila empowering each of them to issue OVRs to erring drivers and motorists. The other provisions of the traffic codes or ordinances remain valid and unaffected by this Decision,” ayon sa SC.

Binigyang-diin pa ng Korte Suprema na ang lahat ng traffic enforcers, maliban na lamang kung binigyang pahintulot ng MMDA, ay hindi maaaring mag-isyu ng OVR at mangumpiska ng driver’s license sa mga motoristang lumabag sa batas trapiko.

Sinabi naman ng MMDA na layunin ng STS na pag-isahin ang kasalukuyang mga batas tungkol sa trapiko at pangangasiwa nito sa buong Metro Manila.

Kalakip dito ang pare-parehong ipapataw na parusa at kaukulang multa para sa karaniwang mga paglabag sa batas nang sa gayon ay pare-pareho rin ang paraan ng lahat ng LGU pagdating sa pangangasiwa sa trapiko.

Matatandaan na kaagad na sinimulan ng MMDA ang pagpapatupad ng STS matapos mabuo ang Metro Manila Traffic Code of 2023 na inaprubahan naman ng Metro Manila Council noong Pebrero 1, 2023.

Nag-ugat ang nasabing kaso noong Disyembre 2006 nang magsampa ng kaso ang iba’t ibang transport group at inalmahan nito ang magulo at wala-sa-ayos na mga probisyon ng OVR ng 15 LGU sa NCR.
