Revision, hindi amendment, ang isinusulong ng People’s Initiative

NILINAW ni retired Supreme Court associate justice Adolfo Azcuna na ang isinusulong ng mga nasa likod ng kontrobersyal na People’s Initiative sa 1987 Constitution ay hindi isang amendment, kundi revision.

Ito ay dahil sa pagpapalit ng anyo ng ating gobyerno mula sa bicameral tungo sa unicameral. Sinabi niya ito sa pagdinig ng Senate Committee on Electoral Reforms nitong Martes.

Si Azcuna ay isa sa mga naging miyembro ng Constitutional Commission na lumikha ng 1987 Constitution.

Bukod pa rito, idiniin niya na ang partisipasyon ng Senado sa isang prosesong lehislatibo ay kailangang para matawag itong an “act of Congress”.

“Let’s say you have 315 representatives and 24 senators. You have 339 in all and three-fourths of that is 254. Of the 254, 18 has to be senators. Otherwise, it’s not an act of Congress,” ayon kay Azcuna.

Idinagdag pa niya na kapag walang quorum ang mga senador, kahit na ang 315 na kongresista ay bumoto ng pabor, hindi nito inaamyendahan ang mga panukalang amyenda, dahil hindi ito ang buong Kamara, paglilinaw ni Azcuna.

Sinabi pa niya na ang isinusulong na People’s Initiative (PI), para masimulan ang pagbabago sa Konstitusyon (Cha-cha) ay pwedeng kwestiyonin, lalo na’t may mga naiulat na bayaran at maling representasyon.

“If we want to change the voting, it has to be done by a Constituent assembly, not by an initiative. In Constituent assembly, you need the Senate to participate that's why it cannot be done,” paglilinaw ng 84-anyos na retired justice.
