NAGLABAS kahapon ng summons ang Marikina RTC Branch 273 para hingan ng sagot ang GMA7 at TAPE Inc., o Television and Production Exponents, Inc. (TAPE) sa reklamo ng Eat Bulaga (EB) hosts na sina Tito Sotto, Vic Sotto, Joey de Leon o TVJ at Jenny Ferre.
Kaugnay ito ng “copyright infringement at unfair competition” na inihain nina TVJ at Ferre na dating executive vice-president for production ng TAPE.
Ang TAPE ay pagmamay-ari nina Romeo Jalosjos Sr. at Antonio Tuviera.
Ayon sa docket ng reklamo, “Copyright Infringement and Unfair Competition under R.A. No. 8293,
otherwise known as the Intellectual Code of the Philippines with Applicaton for Issuance of a Writ of Preliminary Injunction.”
Humihingi ng mahigit P21 milyong danyos ang TVJ.
Sa isang opisyal na pahayag noon, sinabi ni Tito Sotto na 1979 pa unang nag-ere ang EB at hindi pa naitatayo ang TAPE Inc., paano raw nangyaring ang TAPE ang legal na may-ari ng copyright ng
programa? Isa pa, si Joey de Leon daw ang naka-isip ng titulo at konsepto ng EB, at kailanman, hindi nila ito ibinenta sa TAPE.
Tungkol sa kaso, sinabi ni TAPE lawyer Maggie Abraham-Garduque na ang “Eat Bulaga name, the
design of the name and the logo is a ‘trademark’ and not subject of (any) copyright.”
Mahaharap kaya ang tape lawyer sa “contempt of court” (sub judice) sa pag-i-isyu sa media ng
opinyon sa kaso, kahit na nasa korte na ito? Abangan!
