Kaso ni Dr. Iggy Agbayani, muling pag-aaralan ng SC

Siniguro ni Supreme Court Chief Justice Alexander Gesmundo na muli nilang bubuksan ang kaso ni Dr. Benigno “Iggy” Agbayani Jr., ang orthopedic surgeon na nasawi sa kulungan noong Oktubre 5.

Nilinaw ni Gesmundo na gusto nilang alamin ang tunay na pangyayari para makabuo ng isang polisya para hindi na maulit ang nangyari sa doctor. Posible raw na may lapses ang abogado ni Agbayani.

Matatandaan nakulong si Dr. Agbayani sa Manila City Jail noong Mayo, matapos mapatunayan ng lower court na guilty ito sa kasong reckless imprudence resulting in serious physical injuries. Ang kaso ay isinampa ng dating niyang pasyente na si Atty. Saul Hofileña Jr. noong 2006.

Nasawi si Dr. Agbayani sa loob ng kulungan dahil sa heart attack noong Oktubre 5 sa taong ito.

Ayon kay Gesmundo sasailalim sa judicial review ang kaso, at muli nilang rerepasuhin ang Code of Professional Responsibility papra malaman kung saan hindi nagampanan ng kanyang abogado ang tungkulin para maprotektahan ang Constitutional rights ng kaniyang kliyente.

Nitong Nobyembre, hiniling ng Philippine Orthopaedic Association, Inc. sa pangunguna ni Dr. David L. Alagar, pangulo, pati na rin ilang medical professionals na dapat magkaroon ng judicial review sa kaso ni Agbayani.

Tinanong ni Lucino Soriano, isang researcher na, Akma nga ba ang kasong Reckless imprudence resulting in serious physical injuries (Republic No. 1790) na isinabatas noong 1957 na patuloy na ginagamit kahit na sa mga kasong sangkot ang masalimuot na operasyong medikal. 66 taon matapos itong naisabatas?
