Bato hindi “matic” ibibigay ng Pinas sa ICC

HINDI awtomatikong iha-hand over ng pamahalaan si Senador Ronald “Bato” dela Rosa sa International Criminal Court sakaling ihahain dito ang warrant of arrest.

Ito ang sinabi ni Executive Secretary Lucas Bersamin at binigyang-diin na ibang kaso ito sa sinapit ng dating Pangulong Rodrigo Duterte kung saan hindi humadlang ang gobyerno nang isakay ito sa isang pribadong eroplano papuntang The Hague, Netherlands.

Sinabi ni Bersamin na alinsunod umano ito sa bagong kautusan na inilabas ng Korte Suprema kung saan kailangang idaan sa bagong patakaran ang isang extradition na hindi inabot sa kas oni Duterte.

“Hindi na gayun. Batay sa inilabas na bagong patakaran ng Korte Suprema, kailangang idaan muna sa isang korte ang isang akusado bago ito ibigay sa isang bans ana humihiling ng extradition,” ang pahayag ni Bersamin.

Sa ilalim na bagong kautusang ito, kailangan munang tiyakin ng isang korte ang validity o pagiging totoo ng ng extradition request.

Proteksyon umano ito sa isang Filipino citizen at hindi basta-basta na lang i-hand over sa isang banyagang bansa na nag-request nito na hindi muna dadaan sa pagsisiyasat ng korte ng Pilipinas.

Ang nasabing arrest warrant ay may kaugnayan sa koneksyon ni Dela Rosa sa war on drugs sa panahon ng dating Pangulong Rodrigo Duterte kung saan pangunahing ipinatupad ito ng senador.
